HIMIN SOLAR S. L. U., (hereinafter the "Proprietor") is the owner of this website www.himin.es, (hereinafter the "Website"), including all its content, information and services.

Legal Warning

   Anyone who browses this Website becomes a user (hereinafter referred to as the "User") of it and this implies the total acceptance and without reserves on the part of the User, of each and every one of the conditions included in this Legal Warning and any others that may be introduced, at any time, by the Proprietor, without previous warning.

   The access and use of this Website is free for the User and requires no prior registration, without prejudice of the access and use of certain information, services and features offered through the Website that can only be done by prior registration of the User.

10. Applicable law and Jurisdiction

    These conditions shall be governed by Spanish law.

    The Proprietor and the User, expressly renounce all other codes of law and undertake to be bound by the Courts and Tribunals of the User, for any controversy deriving from the provision of the services subject to this Website and its Conditions and on the interpretation, application, compliance or noncompliance of them. In the event that the User is resident outside Spain, the Proprietor and the User, expressly renounce all other codes of law, and agree to be bound to the courts and tribunals of the city of Alicante.

Civil Liability

1. Exclusion of Liability

   The Proprietor makes no warranty or liability in any circumstances for damages of any kind that may result from:

   • Lack of availability, maintenance and effective operation of the Website and / or its services or contents.
   • Contents not being up to date or errors in the access or use of the Website, as well as its services, although the Proprietor undertakes to avoid, update or correct these errors. That is, it excludes liability for the lack of availability, maintenance, continuity and effective operation of the Website and its services, as well as on failures in access to web pages or those from which services are delivered.
   • The existence of viruses in the computer system, electronic documents or files. Similarly, the Proprietor shall not be liable for the presence of viruses on the Website, even if they cause disturbances or damage to the computer system, electronic documents or files from users.
   • The receipt, acquisition, storage, distribution or transmission by users, of the contents of the Website.
   • The knowledge by unauthorized third parties, characteristics and circumstances of the User makes use of the Website and the products or services offered.

2. Indemnification of the User

   The User expressly agrees to indemnify the Proprietor, his group companies, employees, officers, agents, information providers and licensors or service, for any damages (including attorneys' fees and costs) arising from the User's failure to meet these Conditions, and to work with the Proprietor in the defense of their interests in the event of any claim or to initiate or invoke any judicial or administrative proceeding as a result.

   Also, the User agrees to use their best efforts to prevent or, where appropriate, mitigate and minimize the extent of possible, harmful or adverse effects which may eventually accrue to the Proprietor.

Protection of Personal Data

1. Identity and address of the File Manager, where your data is located

   Under the applicable legislation on Protection of Personal Data, HIMIN SOLAR, S.L.U., located in Avda. País Valenciano 9, Elche (Alicante) (hereinafter referred to as "the File Manager"), informs users that by introducing their data via electronic forms on our Website or by sending their "Curriculum Vitae" or contacting us to inquire about our services, they shall be obliged to provide certain personal data to be processed automatically and to be incorporated into an automated data file, previously registered in the General Registry of Data Protection of the Spanish Data Protection Agency, for which the File Manager is responsible.

2. Purpose of the processing of data

   The data of a personal nature, voluntarily provided by candidates when they submit their Curriculum Vitae to this company, as well as other related information, will be held and used in personnel selection processes, which may involve the preparation of training programs or other related processes. The end user of the information produced as a result of the processed data is the Department of Human Resources of HIMIN SOLAR, S. L. U. (rrhh@himin.es)

   The User is obliged to answer the questions on the forms. Refusing to supply the requested information will imply that his/her data are not included in the candidate selection process. The purpose of the data collected through the forms is to be incorporated into the files of HIMIN SOLAR, S.L.U., and processed for the purposes mentioned above. In the case of any change in your data, please notify us accordingly.

   The collection of data on forms called "Contact Form" and "Request for Quote" that exists in this Website is carried out by the Commercial Department of HIMIN SOLAR, S.L.U., in order to take the necessary steps to process the User's application, adapt our offerings to your particular profile, sending commercial communications and advertising, including e-commerce communications for the purposes of Article 21 of Law 34/2002 of the Information Society, and keep the User well informed about HIMIN SOLAR, S.L.U. products and services. The recipients of these data will be the commercial and technical services of HIMIN SOLAR, S.L.U. The User may refuse at any time the sending of such communications via email, being sufficient for that purpose to notify by sending a message to the email address ventas@himin.es

3. Right of access, rectification and cancellation.

   The File Manager informs the User as the data owner that he/she may exercise his/her right of access, rectification, cancellation and opposition in the terms included in the data protection legislation. For these purposes, a simple written and signed request, addressed to HIMIN SOLAR, S. L. U., accompanied by a photocopy of their D. N. I., addressed to ventas@himin.es will be sufficient.

4. Cession

   The User gives his consent, expressly, so that the File Manager is able to share the data with other companies belonging to the HIMIN Group, for activities appropriate to their purpose. Similarly, the User consents to such data being transferred internationally, to different locations of the File Manager or their representatives in the world whose offices or homes are located in a large number of countries (Germany, Italy, Portugal, Romania, Bulgaria, Mexico, Argentina, Brazil and Uruguay). His/her information will be treated with absolute confidentiality. However, the User's consent for the processing and transfer of data may be withdrawn by the applicant's request to the address referred to above.

   The common file mentioned in the previous paragraph is a database of customers and suppliers, which is hosted on a server in Spain, for which HIMIN SOLAR, S. L. U. is responsible. Access to it is restricted solely to the HIMIN Group companies, through an intranet, in a safe and confidential manner. The purpose of the creation and operation of this common file is commercial and organizational: sharing such information is intended to facilitate the search for potential investors and suppliers in the various projects undertaken by group companies in those countries, follow a coherent policy in recruiting providers, send commercial and trade reports and offer commercial advantages.

   The User may at any time exercise their rights of access, modification, cancellation and opposition by sending a simple written communication to HIMIN SOLAR, S. L. U., Departmento de Ventas, Avda.    The File Manager has adopted the legally required security measures at its facilities, systems and files in accordance with the provisions of Royal Decree 994/1999.

   The File Manager cares for the maintenance of the quality of the data the User provides, ensuring that it is adequate, relevant and not excessive for the legitimate purpose of treatment.

   The User guarantees, in all cases, the truthfulness, accuracy and validity of the personal data provided, and undertakes to keep them updated.

   If our data protection policy had to change as a result of legislative changes or criteria derived from the Spanish Agency for Data Protection, any variation as may be necessary to meet the law, would be adequately informed through this Website.
